Eversheds and Exclusive Human Resources would like to invite you to a briefing with the UK Border Agency in Newcastle on Wednesday 03 March from 08:00 until 10:45. Speakers will be Jessie Uppal from Eversheds LLP and Martin Milford from the UK Border Agency.

Background

In recent years, employers have welcomed many migrant workers, who have filled skill and labour shortages, and who are acknowledged to be typically ambitious, energetic and motivated.

However, the rules surrounding immigration are under constant review and a number of changes have recently been introduced to the scheme.

One of the proposed changes from January 2010 is that migrants from outside the European Economic Area will be issued with identity cards for foreign nationals when they extend their permission to stay for more than 6 months under the Points Based System.

The Points Based System covers all employment, training and student immigration, and is intended to more closely match labour demand to labour supply. EU nationals are not affected, and continue to enjoy free movement, apart from some restrictions on work for employees from the newest EU countries.

The benefits of economic migration are accepted - but there are challenges in terms of avoiding discrimination on the grounds of race, colour, religion or belief, on recruitment and in employment.

The penalties for employing illegal workers are potentially severe, including prosecution, fines, reputational damage and withdrawal of the right to employ migrant workers. This breakfast briefing will help you understand how to protect your organisation.

  • avoiding discrimination claims on recruitment
  • checking documentation, the right to work and the continuing right to work
  • the powers of the UK Border Agency, compliance/enforcement visits and assisting inspections
  • the new requirements for sponsoring employers to be registered and commit to new responsibilities
  • what steps to take if employers do not have or lose the right to work.
